Arbitrations resulting from controversies stemmed from international commercial agreements within Mercosur are regulated by the Acuerdo sobre Arbitraje Comercial Internacional del Mercado Común del Sur. Such instrument deserves an important analysis aimed to make a thorough examination of the rules and procedures it regulates since from it several sensitive and transcendent institutions for arbitrations between parties of different States arise such as: the form and validity of the arbitration clause, governing law, general procedure rules, injunctive measure, arbitration award and its enforceability.
